Can i sue my roomate in small claims for mortgage abandonment? the only thing in writing is the mortgage agreement and plenty of paperwork to show that she is also financially responsible for the house.

Small claims is usually only up to $5,000. You would sue in Circuit Court for an amount exceeding $5,000.

I assume she is also on the deed? That could be sticky, consult with an attorney for sound advice.

It would be up to you to collect. The courts do not help with the collection of a judgement.
