Hello,
we signed a management contract on 9/01/09. The contract we signed was fir a year with a price of 750 from us to the manager which was due to be paid on 1/1/10. He is not doing his job and is costing us money. So we asked him if he would take 200 for 2 months of service and be done with everything.

Now he says he will take us to small claims court if we do not pay him the whole 750 by Monday (11/16/09).

My question is, we have 5 members and all of us signed the contract. The contract was not notarized and we have not recieved our copy. One of our members is 15 years old and his parents did not sign. I know he is void from the contract. Are the rest of the members who are over 18 still bound by it or is the whole contract void?
 
If the manager is not holding up his end of the contract the he isn't necessarily entitled to the full 750. He also don't think he can't demand payment prior to the agreed date.
If you end up in court you will likely have to pay him something, but if you can show he didn't do his job you might get the amount reduced to something more reasonable for the services he actually provided.
