Other Criminal Charges & Offenses Battery and petty theft

My son got a cited for a ticket for battery and petty theft. Principal claim he was in a "mob action" agaisnt a young girl that goes to the same school as him but no grown ups was there to witness the incident. They had children that were witnesses and the claims were that the young girl had gotten kicked and punched, and her wallet got removd from her back pack, not in that order. There were no direct claims of my son hitting her or punching her, or opening up her backpack to remove the wallet, my son says that he wasnt even there to see how the incident started but the wallet that was taken from her by another student who was being chased by the girl and gets caught then throws the wallet to my son. My son claims it was randomly thrown to him and the girl chases my son as if she was going to hit him for her wallet, my son runs with her wallet out of reaction and the young girl punched my son in the face and by reaction from the punch my son threw the wallet and it hit the young girl in the face. I Understand that the young girl is victim from being punched and kicked, but apprently my son is a victim from being punch in the face. Im trying to figure out how do an battery and theft comes from this if your just randomly involed. Thank you for your time.

I suggest you discuss this with your child's attorney after he or she has received the facts of the case.

Based upon your description of events, your son was cited as party to the beating because he took the wallet and kept it from her.

Party to one, party to all.

Your son became involved when he chose to side with the beaters of that dear, little child.

He may not have kicked or punched her, but he involved himself when he played "keep away" with her useless valuables.

Party to one, party to all.

In most states, if you do one act with others who did twenty acts, you'll be charged with all twenty acts.

That is the pony your kid foolishly chose to ride.

Your son should have reported the matter.

At a minimum, he should have continued doing nothing to avoid any criminal liability.

Legally, your son needs you and he to discuss this with his attorney.

As a parent, perhaps your child might benefit from counseling.
