I have been told that my room mate in North Carolina in the Catawba County area are wanting to sue me for damages done to their car. The owner of the vehicle claimed she got a tune up on her car after letting us borrow her car to drive up to michigan. On the way back her engine blew and she is claiming we ruined her car. We made attempts to put oil in her car ask for her from her and had another person put oil in the car but it still blew.

What kind of lawyer/attorney do I need?

Don't worry about it. If she should file a suit it won't go anywhere. She has no evidence that you caused damage, and you could just argue that it was wear and tear... would have happened anyway.
Nothing to worry about here.

I tend to agree with Moose. As long as you took due care with the car (didn't drive it while it was knocking hard) or (didn't drive it though it was billowing smoke) and generally took care of it, you are safe from liability. Don't worry about an attorney until you are sued. If you are sued in small claims court (which is likely) you will not need an attorney though you can bring one if you really wish. I would think you will be fine. She needs proof she does not likely have.

Dunno about Carolina- but here in California attorneys aren't allowed in small claims. You can talk with one before and after though.

ahhh ok. well I know that it would be in small claims court cuz her car was a piece of crap and isn't worth much. We did drive it while it was knocking only because we were up in michigan visiting family and when we told her about her car knocking she checked the oil and said that it was fine and wouldn't put the oil that she brought up in the car she drove into her oil tank. Ten minutes down the road we had someone check it with a shop rag because the owner checked the oil with a store receipt. When we checked it with a shop rag it was bone dry.

I know that lawyers aren't allowed in small claims court but I am pretty sure we will need to find an attorney or lawyer to draw up the response papers am I right to assume that?

You really don't need to make that big a deal of this. Just put your answer in layman's terms. That is what small claims court is all about. I don't think you have a problem with this case anyway. Going to an attorney would be a waste of money.
