My landlord falsely accused my husband and I of using illlega drugs in our apartment . We have to younf children. He called the police on us and we had search dogs search our home they found nothing. We were searched and questioned by the police. And was told they they spelled it coming from our apartment from the hallway. But my husband and I have been spelling illlegal drug use in the halls for months . Our mistake is not reporting it to the landlord office. But we are the type of ppl who just minds our business. But that quickly back fired when we was the ones accused. That accusing lead my husband to losing his job over this matter. Now where behind $1000 in rent do to being out of work for months. How do I legally stop them from evicting us ? Do to it was the landlord fault for falsely blaming us. I believe it's .soley because we are very young couple we are the youngest living in our complex so it's easy to assume it was us . My husband also talked to the landlord personally and explained to him that he and I do not mess with any illlegal drugs what so ever . And the landlord explain to him that they had a similar situation with a lady and he sent her a letter of warning. WARNING??? why did he not send us that same Letter if he assumed we were using ??? Instead he called the state authority not even considering we have two small children. My husband and I are also the only African American leasers in this complex I feel that had alot to do with it as well. anything my husband and I can do for this matter. ? FYI my husband has a job now. But we are having a hard time catching up on rent do too other bill expenses
 
You won't be able to stop an eviction if the landlord pursues it.
The police would not have been able to conduct the search based on the landlord complaint. They must have had better reason. Did they obtain a warrant or did you agree to let them search?
It is not clear how your husband's job is related to this.
 
No they did not have a warrent and we allowed the search. Because we had no reason to hide anything. Do to us being young we did not wanna say come back with a warrant when we clearly know we where not doing anything.so it didn't make sense to have the authority go through all that trouble to get a warrant to only not find anything. And we asked the police on constantly what was the reason for the dogs and etcand they just said it was a compliant. And we asked based of a simple complaint caused such a search of the matter? But they never answered those questions they just kept asking to search so my hishusb and I just let them do so. To get whatever they were hoping to find out of the way because we knew there was nothing there.one of the police officers asked us where do we work I'm a stay at home mom so my answer was not working my husband said yes the police officer asked what corporation ? My husband then told the officer who he worked for. And a week later my husband was fired do to that matters . His job never told him how they got the information about the situation at our house hold . So I'm assuming the officer had something to do with it.
 
It appears that you and your husband may have grounds for a defamation lawsuit.

No guarantees, but consult a defamation attorney ASAP.
 
The search was a result of you allowing it. It is your right to refuse.
The jails are full of people who said they had nothing to hide.

Assumptions about why your husband lost his job won't go anywhere. If you could show that he was fired or disciplined because of his race, gender, religion, etc then there might be an argument to make.

It sounds like you are on tough times, but its only temporary if you stay focused and work on to make it better. Don't expect things to magically improve without a deliberate effort on his/your part.

You don't seem to have anything to protect you from an eviction effort if the landlord initiates one. You are responsible to pay the rent even when unemployed. You would be best off to move out before an eviction is filed.Having an eviction filed against you can make it hard to get a new home afterward.

If you don't pay your rent, you're subject to eviction. There's really not much more to it than that.

As far as a possible defamation lawsuit, it's impossible to assess that without knowing exactly what was said (either by your landlord or by the police).
