My brother had a roommate for the last 7 years, who for at least the last 4-5 yrs. didn't pay rent then had his adult son live at my brother's trailer (he owned it) rent free also. My brother didn't make much money and needed a roommate to help with the bills. His roommate was only paying for food stating that he needed to help his adult children financially and was unable to pay anything besides groceries. My brother was older than I by 16 yrs. Since our father passed away in 1990 I had been his only beneficiary. I am my brother's only closest living relative. My brother suffered a heart attack and a stent ~6yrs. ago. When I talked to his roommate he would only talk about money and that my brother needed to make him beneficiary of some of his money in case anything happened to my brother. I was agast at his gaul! Then 3 yrs ago my brother suffered a seizure and found he was diabetic. His roommate harrassed him and me about the beneficiary thing again and my brother, not being well, switched his roommate to beneficiary of some of his money. Again, I saw a gold digger who was sponging off a sick man. His roommate's lack of payment left my brother paying all the bills and unable to pay some of his medical bills and he couldn't even afford liability ins. on his car!! My brother suffered a major heart attack and was subsequently delcaired brain dead in late April and he was taken off life support and passed away. Approximately a month before he died he told my husband and myself he was trying to find a way to get rid of his roommate and his son. Also, he said he planned to change me back to beneficiary of the things he had put his roommate on. Here's where it gets tricky. My brother was such a procrastinator that he hadn't changed it back before his sudden unexpected death. His roommate again did nothing but call me 3-4 times a day about the money he was to inherit. It make me crazy. Here I was in distress over losing my brother and he was supposedly his "friend" and only seemed to care about the money. Before my brother died, while he was comatose, I went online and changed his retirement plan beneficiary from his roommate to myself. I probably shouldn't have, but I was in distress about this "conman" getting my brother's money. I don't want any claim on the money. I want it to go to the state and have a park or highway in my brother's memory. He is now suing me for it, but has not filed a report. His lawyer talks about internet fraud and felony offense. They talked me into signing a waiver of the money to make him beneficiary again and they want me to pay his attorney fees which I signed by myself without legal counsel because I was under duress and scared about charges being filed. I've never had anything more than a speeding ticket and am a upstanding citizen. I've been married for almost 12 yrs. and have 4 wonderful children two of which are special needs. I'm scared to death and don't want to keep looking over my shoulder until the statue of limitations runs out. Then if someone wants to they can still file a report. I have called his attorney and left a message that I've changed my mind and want to seek counsel. I have a call into an attorney who I hope can help me, but I was wondering how much trouble I could get into with this and what I'm facing. Could you please help me? I really don't want to go to jail. I was just looking out for my brother's best interest and his last wishes, which he was unable to put into writing. By the way, he had no will or POA. I inherited his life ins. which I used in part to pay for funeral expenses.
