I am being sued by my divorce lawyer. Being on disability since then, can he win, when I have no money? Plus he overcharged me and wasn't very professional speaking with me.

Never try to determine who will prevail in a lawsuit.

You should defend yourself the best way you can, just tell the truth as you understand it.

Because you're on disability income, the lawyer's ability to hurt you financially (should he prevail) is limited to about 15% of your disability benefits.

If, however, your disability is related to SSI, that is untouchable, as regards any judgment.

Good luck, and let the chips fall where they land.

Having no money has nothing to do with whether or not somebody can win a lawsuit against you. Depending on what type of disability benefits you get, they may be fully exempt from judgment per MI statute 600.5451.

he overcharged me

File a complaint with the MI Attorney Discipline Board:

If your representation is true, the worst financial impact you could suffer at the hands of the IRS is 15%.

In Texas, for example, the lawyer wouldn't be able to get so much as 1%.

SS Disability proceeds are protected by Texas' constitution and Homestead Exemption Law.

In Michigan, the same is true, your SS Disability proceeds are protected from levy, too!!!
