Shoplifting, Larceny, Robbery, Theft Best Buy First offence shoplifting

My question involves criminal law for the state of: Michigan

Someone who is not me (SWIM for short) got caught shoplifting from Best Buy. This is Swim's first offense. The amount of the item was approximately $156. Swim was taken into a room where an Loss Prevention Supervisor held Swim. Swim confessed to taking item and pleaded for forgiveness. Loss Prevention was not in a forgiving mood and called Law Enforcement. Law Enforcement showed up and took down some notes on the stolen item and then took Swim down to the Police station. Swim was then booked (fingerprints/mug shot). Swim was baled that night. Now Swim awaits a hearing which they will be notified of by phone of mail. Swim was never read Miranda rights. Swim was very apologetic to the nice police and the police kind of acted like it was a joke. Swim has a history of depression and extremely low self esteem/memory problems. Swim has sought medical help for this in the past but currently does not take medication for said problems or under the supervision of a doctor due to a lack of insurance. Note non of this is an excuse for SWIM. Swim is unemployed and has been unemployed for 2 years.

My question is what should a lawyer cost for this kind of case? Do they need the money up front and can one make payments to the lawyer. What would be the worst that would happen to swim? Does swim have any chance of having this expunged from their record? Swim is worried about the fact that they were booked and now will not be able to find work.

That depends on what "swim" wants this Attorney to do
Do they need the money up front and can one make payments to the lawyer.
"Swim" can discuss this with Attorney

Worst? Jail
Does swim have any chance of having this expunged from their record? Swim is worried about the fact that they were booked and now will not be able to find work.
"Swim" should discuss the availability of a Diversion program in his case

Thanks very much for your reply! Should swim seek a lawyer now or when they are notified of the hearing? Swim has almost no money and is told that a lawyer will probably run $2,000 for the total services involved.

"Swim" should start calling Lawyers now! Many offer free consultations. Then "Swim" can have some knowledge of what to talk to his Public Defender about

So Swim spoke to a lawyer yesterday. The Lawyer told swim that they would plead guilty. I always thought it was important to not plead guilty no matter what. The lawyer was confident that he could get swim into a program which if swim kept his hands in his pocket for a year that the conviction would be cleared from swims record, but it would still show an arrest. Is this normal? The lawyer would charge a total of $1500 for their services. Is that normal?

Btw this is a city vs. Swim situation here.

Swim went on google and found 2 lawyers who specialize in retail fraud with free consultations, one is not answering there phone. Is there any other way to find decent lawyers who specialize in this kind of case?

I do not adivse posters to go against their Attorneys advice. If your Attorney is advising you to plead guilty rather than no contest to get record removed after probation then he (The Attorney) is best suited to give that advice
