Larceny charges for a person who found a cracked/broken cell phone a sign of of mass incarceration culture in USA. My boyfriend is Gay/Trans
We feel this is very unjust and would like to know if there is grounds to file an injunction to stop the criminal charge proceedings or if there is a legal precedent that can apply to this case.
I am sure my boy friend had no intention of depriving this phone from anyone. He has in the past always returned things to people when he has found lost items. He even has known to go out of his way to do this and always makes a point of returning things to people, he is not that type of person that would keep someone's phone. If he needed a new phone he would buy a new one not take a cracked one from the floor of a store intentionally.
We know these charges are serious but the circumstances around the case seem so over the top and draconian that we are reaching out for help. We know we need a lawyer but that doesn't even seem enough. The item in question was described in the police report as a cracked/broken phone. We have done our research and this phone is likely worth <$100. Yet they are describing it conveniently as worth so much more which puts him in that much more trouble.
Police seem to be trying intentionally ruin his life. His only prior involvement with the law which was unrelated at the time, a non serious and at the time pending charge that involved a motor vehicle incident (not an accident) 9 months ago and it's currently being reviewed by appellate court. During this trial the witnesses against him which were the police from another department were accused of foul play.
My boyfriend was recently charged with unjust criminal charges that say a lot about the mass-incarceration culture even in Massachusetts. These charges have no legal ground, the police had no probable cause and my family think it may be fraud on the part of the young lady who claims her phone was stolen, while it appears it was merely lost. She may be making claims so she can benefit from possible insurance fraud because she "lost" her phone, it doesn't make sense and this seems probable.
However this case is proceeding. My friend was charged with felony larceny because he allegedly picked up a lost item from a floor in a large chain pharmacy store, similar to WALGREENS. In the police report it was described that he picked up an item left on the store floor after the victim (female) left her SELF described "cracked phone" on store floor in cosmetics isle of store..
My boyfriend has perfect credit, has been in magazines and newspapers for his environmental activism and has many friends and family that would give credit to his character.
Victim claims she made some purchases, left the store, realized her phone was not on her person anymore and then called police to track down the phone.
Police claimed they saw my boyfriend picking it up in the store on security cameras and were able to discover my friends name because they obtained his contact info by pressuring his credit card info to release this info. (illegal?!) (warrant?) This is described in the police report.
He allegedly made a purchase at the store after he allegedly found the phone and the detectives from this Massachusetts town in question apparently pressured his credit card info into releasing his name and info once they discovered he made a purchase and tracked down his info. Doesn't that require a warrant?
My boyfriend allegedly saw it on the floor and picked it up, there was no one else in the store he remembers and then he proceeded to checkout and pay for some items. Possibly even at self checkout. He doesn't remember that exact-day but he usually does self checkout at that store because they are "always understaffed' he says. In the police report victim immediately that day called the police and reported the phone was stolen. She says she came in after shopping and realizing that after she left the store she came back and reported the phone stolen to store staff. My boyfriend and the victim of her lost phone never were in the same place or area at the same time.
The police claim they came back the next day to review CC store footage and they claim they discovered him by linking private info about the credit card charge he made, which was likely illegally obtained info without a warrant from his credit card company. If my boyfriend made a purchase it likely would have been made at the stores self checkout and leaving the scene without any knowledge of the the woman.
Police claim they tried to get in touch with my boyfriend and because they couldn't they came to the conclusion he intentionally took the phone with the intent of depriving the woman who left it on the floor of the store?!
They issued a warrant for his arrest over this. Once he discovered there was a warrant he immediately appeared in court, released on his own and now it's an ongoing case.
We believe this is a disgusted abuse of police powers. They immediately had a bias at the start and tried to fit the circumstances to fit their case.
