i fathered a son with a married woman. The legal father is on the bc. The legal father and mother divorced after my dna test showed me to be the biological father. The mother and i resumed our relationship, were engaged but never married when she passed away last year. i have an established loving relationship with my son who knows now that I am his real father. I lost the first custody battle with the legal father (appeal pending) and was granted no visitaion and have been denied any communication. The legal father is talking to other family about going after child support from me even though I have no visitation or communication rights. Do I have to pay child support? My attoeney is 425 /hr regardless of if its a phone call.

It is unethical for an attorney to speak with a person about his or case when its KNOWN that she or he has retained counsel.

Spend another $425 for an answer.

There are no free lunches.

How is it you had DNA to establish yourself as Father yet other man is legal Father? Was the DNA test done through courts?

Maybe it's due to the age of the child. See link above posted by Proserpina.

The legal father (as in putative father) is by common law and state statute the man to whom the woman is married when she delivers the child.
