My father was raised in SC by friends of the family who actually gave him THEIR family name. My father is about to retire in a few years and he must produce a birth certificate. He doesn't have a birth certificate in the name he has been using since a child, but has found out their is one that exists for him in another Last name (he was born in Philadelphia). Also, there is no BC for him in the name he has been using. How can we go about having it legally changed to the name he has been using. He does have a SS# and driver's license in the name he has been using as well.

Contact the folks who issue birth certificates.

His actual BC is in (fictious name) Smith, but he has lived under the other name Jones. How can he have it changed w/o a BC in the other name Jones he has been living with?
He has a Driver's License and SS# under Jones, but no BC.

Find a lawyer who does name changes, it's not that expensive at all. Also some states have laws about using a name for a certain amount of time and you're known by that name is legal. Google name change laws for your state. So just have him bring all the information you gave us, the SS card, etc..his original birth certifcate, and maybe a notorized letter from the people or relatives of the people who "gave" him his name explaining the situation to the lawyer.

Did you only try one lawyer? Look in yellow pages and some will have name change listed. It's a very simple procedure and should not cost that much. It doesn't change the birth certificate, but you get a name change affidavit. Google name change and your state to get more information. Your state may even let you do it yourself.
