Boyfriend of custodial parent

Hi all,

The father of my girlfriend's 1.5 year old daughter is counter-suing her for full custody of her child and he's making me the center of his argument. The both have attorneys. He hasn't seen the child since she was four months old although this weekend they are going to start visitation.

The center of his argument is that I, as her boyfriend, have marijuana possession charges that are from 8+ years ago. I can't pass a hair follicle test and for this her attorney is advising her to stay away from me at least until the custody case is finished. Can I be drug tested?


I am close with the child and never have I done anything illegal in front of the child.
I don't use ILLEGAL drugs. I don't live there and haven't since November of last year (2012).

Do I have a lot to worry about?

This is a civil matter.
No, you don't have to say anything, or do anything.
If you're smart, you'll stay far away form these two idiots and their little mutt kid.
You aren't married, and you're free to do what you wish.
Stay out of this, and find a new girlfriend WITHOUT kids.
Your life is simple, keep it that way by avoiding these drama llamas.

Admitting to ANYTHING, is stupid and unnecessary.
Just stop talking, admit to NOTHING, and don't do anything in front of kids or WITNESSES.

I believe I've answered your question elsewhere, but here we go.

If her attorney is advising you to stay away, then stay away. Don't be the reason why she loses custody of her child.

I gotta ask though - why won't you pass a hair follicle test?

Come on AJ - it's one thing calling the parents idiots, but don't insult the poor child caught up in the midst of it all.
