Boyfriend trying to steal my mobile home he acted in bad faith

I had recently moved my now ex-boy friend into my home.
My ex husband had been in prison and wanted to sell his intrest in the mobile home we owned together so he would have money to get back on his feet he had aske for far less then his fair half with the stipulation I would allow him to parol here temporarily my boyfriend was more then agreeable and had a cashiers check waiting for his return,
For several days prior to us going to the assesors office there had been many conversations about our divorce and it was my boyfriends strong opinon I should remove my name on the title until I filed for divorce that way there would be no confusion or problems with the title transfer.
He assured me as soon as I filed divorce my name was to be placed back on title but until the divorce was filed there could be a problem because of maritail asset and he also knew I was going to my maiden name so he convinced my that it was easier this way.
It was very convient the day he choose for us all to go in that he could not go during his lunch hour so we had to go at his break so time was very limited and that was another reason to not "make things complicated" trying to explain why just the husbands name was coming off and mine was staying on....Made sense to me then sounds so stupid and idiotic now but I allowed my name to be removed until I filed divorce which I did the next week.
He at first would not go and change it because in Colorado a title transfer can only be made after 30 days from the first one which I did not know at the time and since then he would avoid the subject all togather.
I have people who know first hand what the deal was and that will testify they had discussed the flaws in my agreement to this and 1 friend point blank asked the boyfriend if he was trying to rob me.
He had never forwarded his mail from his previous address and is living there again.
We had gotten into a small arguement last weekend and he pulled the get your sh*@ & get out of my house card...the next morning I said If my name was not placed back on the title the next day it was over between us well the following Friday he came home from work and moved out.
I have asked him if he would take a payment for his part that he paid including extra for the hot water heater he replaced he flatly refused and stated he is planning on selling it.
He has sent e-mails confirming that the name removal was temporary and that he was only buying out half intrest.
I have a signed copy of a final wishes (will) stating that he was leaving his share of the house to me if anything sould happen.
I am the only one on the lease for the mobile home park and I have lived here for 3 1/2 years before all this has happened.
He sent me an e-mail stating that he only had to give me 10 day notice to vacate and to consider myself served and get out of "his" house
My question is can I file a repliven to demand my possesionary right placed on the title and have an investivagation started into his fraud and action of bad faith?
He also sent the cops here for a welfare check claiming I had threatend suicide which I absolutly did not! I know there is something I can do just not sure which steps to take.
The ex-husband also will testify that the boyfriend only bought out his intrest.
Help, can I file for a restraining order on the grounds that he would not return the house key and that he stated he can come anytime he wants?

Yes, replevin is the proper action to pursue in this matter.

Do not vacate the home.

Only a judge can irder you to be evicted.

He can ask you to leave.

You can ignore him.

He then has to take you to court.

You can try to raise replevin at that hearing, but it could fail.


It is better bring a replevin motion separately.


Good luck and stay put. Do not vacate because he demands it.

You've got a prima facie case for replevin relief. Go get it!!!
 
Thank you for your time, I filed the repliven just waiting to get court date set which will be SOON.
I am afraid of what he is capable of now, since I never knew who this man truley was, the level of premeditation involved to gain the title is such criminal behavoir and the callous actions to try and make me homeless makes me watch over my shoulder and hope he won't run me over in the car or try and sabatoge my car.
Are my concerns enough to have a restraining order to stay off the property at least until this settled.
I work out of town for three week "hitches" and I will be leaving shortly after the hearing and I am afraid he would try and gain acess and come into my home.
If by the fickle finger of fate I loose my home I understand he must give me at least 3 months to move out because I have lived here for x amount of years is this right?
