I have recently been served with a summons for Breach Of Contract, from what I believe is a Collections company for a past Landlord. My question is, is it too late to try and settle this out of court by contacting the lawyer, or since I've been served is it now too late. What is my next move? My main concern is it putting a bad mark on my credit, because I am in hopes of purchasing a home this year. Must I appear in court and take care of it there?!! Please help!

Thank you
Rachel

Try to call the attorney and work out a arrangement-- you are not too late-- try and do everything you can before court-- if you cant- then still go to court and let the judge know you are willing to do payments etc... Your credit might already be hurt-- you might want to take a look @ it-

Yes, but it would still be a derogatory item -- however if it says Paid in full-- you can always explain what happened to a potential creditor--

I would use your credit as leverage for them to get their $$--- " If I pay you, then you remove your trade line on my credit" try to negotiate with these folks-- I am sure they would rather be paid then sit on a credit report for ever--- But like I said it really depends -- a negative Paid in full always looks better then negative owing balance.
