Breach of contract?

When I bought my new vehicle, I was asked to post date 3 checks to cover the down payment to be deposited 1 month apart for 3 months. I have been told that this is a breach of contract and should I decide I no longer wish to own this vehicle for whatever reason, that I could take the dealership to court and recover all money paid and I could return the vehicle. Is there any truth to this?

If the request isn't in the contract, proving you were asked to provide post dated checks will suddenly become impossible.
Toss in the fact that the law doesn't recognize a "post dated" check as anything more than a check, I see nothing to indicate the seller breached the purchase or sales contract.
I suggest you read the documents you signed, proving to yourself post dated checks failed to breach your contract.

It could be a breach of contract with the bank if they were not aware of these post-dated checks. However, the contract would simply revert back to the dealership and you would owe your payments to them. Now if the dealership did not want to take on that hassle of collecting from you every month, they might agree to let you give back the vehicle and walkaway.
