breaking lease

I have lived in my apartment complex for 8 months with no issues, then in the last month I have been sent 3 noise complants and the complex is threatening to evict me and my roommate. The issue is we can prove that we were not at home during 2 of these complaints. The landlord is refusing to listen to me and when I showed proof I got told we need to "quiet down at night". We aren't here...and they are still harrassing me telling me they are going to kick us out if we get one more complaint. At this point I don't know what else to do. I can prove the complaints are unfounded, but if we are kicked out for noise complaints it will make finding another apartment very difficult. Do I have a legit reason to break lease due to the fact that I feel I am being attacked and harrassed by the management? Please help. I have a perfect renter's history with no complaints from any previous complex.

You have three choices

1. Hope problems goes away

2. Wait for eviction and prove your case

3. Ask Landlord to release you from lease and find new place

Personally I would try number 3:yes:
 
You discuss the issue with the landlord. We can't tell you if they will agree to releasing you from your lease. However, keep in mind that it costs them some money to file against someone for an eviction (only a court can issue an actual eviction and to do that a landlord must file for this) and a landlord may simply see releasing you as a good decision for everyone involved.
