Assault & Battery Broken Jaw from a sucker punch in Kansas.

About two weeks ago I was at a night club and I was sucker punched in the mouth. All I did to provoke the punch was talk to the guys sister. Anyway, he caught me pretty good and broke my jaw in two places and my jaw is now wired shut. He was arrested for aggravated assault and I am pressing charges. Also the guy was only 19 and the club is 21 and over, so he shouldn't have even been there.

I am obviously going to have some serious hospital bills but I want to know if the club can be held responsible and if I would have a legitimate case to sue for more than just my hospital bills and the week I was out of work?

The State of Kansas is committed to helping victims who meet the eligibility requirements of the Kansas Crime Victims Compensation Act.

While no amount of financial aid can erase the trauma of crime, it is the goal of this program to ease the aftermath of crime for the victim whenever possible.

The above, notwithstanding, you can also consult with an attorney.

However, it is highly unlikely that bums have resources to compensate you for your injuries.

But, you can also consult with the prosecuting attorney or his/her office.

It is often possible to have the sentencing judge order that this bum reimburse you as part of his sentence.

That way, the court will see to it that you're paid through the probation department, corrections department, or state parole authority.

How Much Can I Recover?
A crime victim may receive up to $25,000 in compensation. Funeral expenses are limited to $5,000.
These amounts are established by state law. The amount awarded must be reduced by amounts received
or to be received from other sources such as:
• Restitution from the offender
• Employee benefits, health insurance, workers' compensation, other insurance, etc.
• Public (city, county, state or federal) funds, i.e., Social Security, SRS

The Kansas Crime Victims Compensation Board provides victims with financial assistance for loss of earnings and out-of-pocket loss for injuries sustained as a direct result of violent crime. This includes reasonable medical care, mental health counseling or other services necessary as a result of the injury. In the event of the death of the victim, reasonable medical expenses and the partial cost of funeral, burial or cremation is reimbursable.

Personal property loss is not covered, with the exception of clothing and bedding seized as evidence.

If the 19 tear old was at all intoxicated then you may have an even better claim against the club.
You will need to speak with a local attorney to sort this out.
You should have no trouble finding a free consult.
