Ten months ago, there was someone very close to me that was brutally assaulted by his Neighbor. Now, this Neighbor has been directly targeting me, a minor, and I have substantial fear that he has the intent to inflict harm on to me based on his past actions. I'm going to outline what has happened from the beginning, how it invloves me, and where I stand to date. I am at a wits end, and I'm asking for any professional legal opinion that can help me.
Last Summer, my girlfriend's father, 43 of NY, was brutally assaulted by his Neighbor, 40 of NY. Her father just arrived home from work in the evening, and was taking out garbage to the garage. Their garage is at the edge of their property level near their Neighbor's fenced yard. When returning from the garage, his Neighbor jumped across his fence, doing damage to it, came up from behind to my girlfriend's Father, and repeatedly struck him in the back of the head, the back of the neck, and the side of the face with an unknown metal instrument. He immedietly became unconcious and fell to the ground. After stiking him, the Neighbor left him lying unconcsious on the ground in his own pool of blood and returned back to his property. This all took place, as his six year old son was also outside, witnessing the whole event. (Attactech is a picture after paramedics arrived escorting him to emergency paramedical assistance)
Paramedics and Law Enforcements arrived. My girlfriend's father was escorted to the local hospital regarding his serious injuries and severe head trauma. He was later diagnosed from numerous doctors as permanetly legally blind, permanetly legally deaf, without assistance from hearing aids, and legally classified as 'Disabled' due to his severe mental instability. He was also instructed that he would never be able to work another day in the remainder of his life. These are permanet injuries that he still harbors to this date. It was dictated in medical records, that ALL of these injuries were directly caused by his Neighbor's violent actions against him from the night he was assaulted.
Legally, I am not exactly sure what actually came of the Neighbor the night of the assault. All I know was by the time they came back from the hospital late in the next morning, the neighbor was home with his family (wife and two younger kids). This is currently a case that has gone under the NYS Supreme Court and is ongoing between my girlfriend's Father and her Neighbor to date.
I didn't become involved into this whole mess until roughly a month ago. This neighbor would repeatedly harass and "flip me off" from his property line when I pulled in to their driveway. Knowing of his violent past I did nothing but simply look the other way. Then he began directly theatening me verbally, from his property line. He then began to videotape me and all members of my girlfriend's family as we entered and exited their house. He would stand on the edge of his property line with a handheld camera and pan across my girldfriend's property at all of us. I cant forget to mention the 3 "security cameras" he has directly facing into my girlfriends yard and house. However, the final straw was when I was leaving my girlfriends one afternoon to leave for work, he pulled out directly behind me. He followed me ALL the way to work. One I arrived, I pulled into my work parking lot and sat in my car to see what he was going to do. He however continued to pull around the parking lot and exit, leaving the way he came. After this event I went directly to the police making a formal complaint about everything, including his stalking. The DA and Judge thought it was necesarry to file a order of protection for me against this man.
After he was served these papers and stated that he would have to appear in court, the day after I got a letter from his attorney. This letter accused me of creating a facebook website that stated what happened to my girlfriends father over the summer regarding his assault. His attorney also stated in this 'letter' that I am directly threatening the welfare of his family. I had no affiliation with creation of such a facebook page, over 600 people joined and 'became a fan' on facebook, I was one out of 600, there have been many rumors about who created the facebook page, but he directly targets me. There was also no mention of the Neighbor's name on this website. Is this a form of slander, for accusition without any evidence? If he is going to accuse me, would he not have to accuse all 600 members who became a fan of this page, otherwise wouldn't he be targeting an individual? And could accusing me of creating a website be any form of harassment that would inflict with the current order of protection I have against him? Also should I even be worried about this "letter" from his attorney, as of no formal charges were pressed... is this more of a scare tactic than anything else? This is currently the latest that has happened.
What else I'm specifically trying to find, are the surveillance laws for NYS and if there is any Federal Laws stating surveillance. It does not seem justifiable that a 40 year old man can legally stand on the edge of someone's property and videotape them to cause harassment. Most specifically to underage minors. I am trying to find, that if it IS legal, does there not need to be a "disclaimer" stating that there is 24HR Surveilance, like there is in places such as walmart or mcdonalds?
