CA points/automatic traffic school

Couple questions -

I recently received a citation for failure to stop at a stop sign in California. It was in my local area and I think I stopped. The officer said he "heard me down shift but never heard me go into first". I believe he assumes I didn't stop. He was targeting a specific stop sign and claimed as a motorcycle patrol, he didn't give warnings (although I know he would because he gave me one previously for a stop sign I really did roll - can't use that one in court though...). I surveyed the area he would have been in and I really do think he could not see the stop line. I'm planning to fight the ticket, complete with pictures, etc through written declaration. I think I have a reasonable chance.

I more recently received a speeding ticket for 87 in a 60 in the middle of the desert. Not sure if I will be offered automatic traffic school. I know you can only use that once in 18 months but I wasn't sure if the pending stop sign ticket would effect that option. Figure I'm pretty much dead on the speeding - it was radar, I just didn't see him until it was too late. Are the license points for speeding the same regardless of how much over the limit you are in CA? I asked if the officer could give me a break with the speed on the ticket but he pretty much wrote everything as is.

Goal is to avoid points and insurance cost increases as much as possible. I'm not too concerned about the one time fines. Any advice and info is appreciated.

California Traffic School Online

You will receive a courtesy notice on each ticket and they will tell you if you are eligible for California Traffic School. You can only take the school for one of the tickets and the speeding ticket is normally not automatically elligible. Usually you have to show up in court and request the school if it is over 20mph and it is up to the judge.

If you don't receive the notice in a couple of weeks then be sure to call the court or show up on your court date. Not receiving the notice is no excuse. My advice would be to show up for the speeding ticket and try for the online traffic school. Then do the Trial by Declaration on the stop sign ticket. It just depends on how they schedule your court dates. If the officer on the speeding ticket does not show up you can request that the ticket be dismissed.

On the Trial by Declaration be sure it is properly filed and in the proper format. Send it CRRR so you have a record that in was received on time by the court. If you are found guilty you only have ten days to request a new trial. Here is a link for more info on online traffic school:

Thanks for the advice. Hopefully, I can avoid showing up in court for the speeding ticket as the county was Inyo (about 300 miles from my residence). We'll see. Still no courtesy notice from that one yet.

The stop sign trial by declairation is under way...
