can a minor be charged as an adult if they had intent before it even happened.

one of the greatest people i know has been trapped all the way around! he was at a party, the guest list included people 18 and up, at around 3 am more people show up including the supposed victim. more than half the party heard her say she was above the age and that she was going to have sex with somebody there maybe even 2,3,or 4 at the same time. my friend went to his bedroom after this when he was in there sleeping she went in there took her clothes of and orally sastified him. when everyone was awake the next morning she went home was confronted by her parents and said god knows what. later that day the cops went to the house were the party took place and talked to the owner/renter saying rape. the owner/renter called my friend telling him the cops are looking for you and they were saying rape. he went to the station talked to the police confessed what he did sighned his confession and then was told that it was a statutory rape charge. if a child with intent of murder can be charged as an adult why cant a child with intent of sex be charged as an adult? on most statatory rape charges the victim is always that the victim, in this case everything points to the victim being the one who should be held responsible for her own actions and not just some underage child who was taken advantage of and didnt know what she was doing.

However, the whole POINT of statutory rape is that a person who is under the age of consent does not have the mental and emotional capacity to consent to sex. It is quite likely that your friend knew or should have known how old this girl was and should not have had sex with her. I guarantee he should not have gone down to the Police department unrepresented and signed a confession. He is in some VERY deep water and better hush and get an attorney. You, take his plight as a lesson and if you think a girl is underage and you are an adult, DON'T DO IT. The adult is the one with the ability to make informed decisions, not the child.

ive done a little more research and its sounds like hes up that one creek without a paddle. the child can not be held responsible no matter if she lied, has done this before, or even if she is one of the dirtiest lil girls around the state.hes looking at 5 yrs min and a registered sex offender title for the rest of his life. im not taking his side, he confessed he did it. it just has me puzzled that people bend laws to show minors acting as adults in multiple casses, murder, stealing, etc. but it seems this law is iron clad.
 
I don't disagree with you. I think especially when a girl lies about her age (even if she shows you a fake id) I don't think statutory rape is appropriate. I also have real misgivings about the sexual offender registry for those who are not predators. Hope your friend does ok. Good luck.
