Arrest, Search, Seizure, Warrant Can audio recorded on a surveillance system be used for a warrant?

On edit: I mean can it be used to provide the police with a reason to question my neighbors regarding their involvement in a crime?


I have a surveillance system with both audio and video capabilities.

I have a sign prominently placed that states "AUDIO SURVEILLANCE ON THIS PROPERTY."

Last night, my neighbor across the street had his car stolen. On my system, I picked up the pricks from next door talking about "getting that car" and another saying "don't get caught" while they were partying on the sidewalk in front of my house.

Can I legally provide the police with a CD of the audio and video that shows what happened?

Since they came to you and you did not sneak in to record them, I don't see why you couldn't offer this to the cops.

If it makes you feel better, tell the prosecutor you will supply it if subpoenaed.
