Can Business (Tenant) Charge Employee For Parking?

Hi,

I work for a hospital and the hospital leases a section of a building that I work in. There is another business that leases the other half of the building and a store across the parking lot in another building. This entire area is owned by a landlord. The landlord does not care about parking and does not want to get involved. The are 100 parking spaces in the entire parking lot. The hospital leased 25 spaces. The hospital is charging 40 bucks for employees to park in the 25 parking spaces. The rest of the 75 spaces are shared by two other businesses which is free parking for anyone (first come first serve basis) customers and employees. Here are my 2 questions:

1. If the 25 spaces are designated parking spots by the hospital and I park some place else in the lot, like any of the free 75 spaces can the hospital tow by car for not paying?

2. If the 25 spaces are not designated spaces and I am the 26th person of the hospital to park in the lot anywhere can they tow my car for not paying?

Check your employee handbook for employee parking policies. If none, then check with your HR department if they have any policies. Good Luck!

A policy is not in place until June 1st. The Hospital doesn't own the parking at all. The landlord owns the building and parking lot. As part of the lease, the hospital has 25 spaces. which should be dedicated spots, but I think the hospital doesn't want to pay more money so they are saying 25 spots anywhere. That is a gray area to me. IMO you can't just have any 25 spots anywhere in the lot and tow anyone's car.
