my co-worker has been working in the company for about 4yrs she was promoted to a full timer about 2yrs ago. since than they hired another full timer after alleging there were already too many full timers at our store.. about 3 months ago they promoted one of our co-workers to full timer and gave him assistant mngr position.. and now they said they cant afford too many full timers that she is a good worker and they have no problems with her work but thay have to take her full time away.. that just does not seem right.. is there anything she can do to fight this since she is a senio employee?? they also for now cut her ours giving her 32 instead of 40 but none of the other full time workers got their hours cut.. she kind of feels discriminated upon... any thoughts?????

Outside of unions seniority cuts no ice under the law.

Unless she has a bona fide contract or CBA that specifically guarantees that her hours will never be cut, the employer may schedule her for as many or as few hours as they have need for her to work.

Does she have a valid and supportable reason to believe that her, and only her, hours were cut BECAUSE OF her race, religion, national origin, or other characteristic protected by law? If not, then this is not illegal discrimination, even if unfair.
