Hello,

I need help to decide if I should appeal below case for my surcharge notice or not :

Accident happened in parking lot of my apartments building. One side of parking lot was clean where my vehicle was parked and other side of parking lot was slippery covered with snow. I pulled my car from clean side of parking lot and was driving towards other side of slippery parking lot. As soon as I took left turn and entered other side of parking lot my car slid and struck other unoccupied parked vehicle.

I have a police report which states that my car struck when I was attempting to turn in snow covered road.

I will appriciate if you can advice me to appeal surcharge notice or not.

Thanks.

Regards,
Denny

I would think not. You knew the road was covered in snow, and packed snow becomes ice. Also there is the possibility of ice anyway.

Hello tpajet,

Thanks for the reply. I was not aware of the other side of parking lot is not clean. I was driving at 5 MPH with assumption that other side of parking lot must be clean as the side of parking lot where my car was parked was cleaned and plowed. My apartment landlord did not clean other side of parking lot very well and it was icy and slippery.

Let me know what you think...

Thanks

Regardless of the conditions, you are responsible for the safe operation of your vehicle. Slippery or not, you are responsible here.
