I am being accused of 'giving away merchandise' as cashier at the register. On the day i was terminated i was pulled into the back office by LP and interrogated. They accused me of not scanning every item for same individuals on 3 occasions. I said I knew nothing about what or who they were talking about and left. Four months later a detective calls me to talk about that incident. They say they see me on the cameras scanning each item but reducing the total price. They said it was around $300 in merchandise. I gave them the same statement as the LP guys. I asked what I could be charged with and he could or would not tell me because the investigation is still ongoing. Even if I really did this which i did not, no merchandise was taken out of the store by my hand. I have not been arrested or charged yet.
Do the police have a solid case against me if nobody can prove that I did or did not know the customers?

Also what is the statute of limitations in Texas for this type of incident?

If register reciepts and CCTV footage show that items left store that were not paid for then yes you can be charged. Its looks worst if its same person more than once! The statute of limitations will depend on whether this is a felony or not. At very least your looking at one year min before they have to charge you. Just a note LP do not begin these investigations without good cause. If you have been questioned already then they likely already have strong evidence against you. Do no tanswer anymore Police or LP questions without an Attorney present

The only information they have against me are the video and maybe the receipts showing a price lower then it should be. There is no related connection to me and the people they are talking about. I haven't even seen the video. What often occurs in the store is some people would get a basket full of merchandise and use many coupons that could bring the price down by $100 to $200.

What factors would constitute this as a felony?

What kind of charges could be brought on me?

You dont know what video or transaction records will show at this point. Depending on dollar value or other factors (se local laws) it can be a felony. Once again depending on local laws we dont know what charges can be filed. do not talk to Police or store without an Attorney

You physiclly lowered a price or did not scan an itme, doesn't amtter if you know the customer or not. I've had many "sweetheart" deals where the employee was just mad at the store so they discounted/lowered items. I'd get a lawyer if I were you.
