Hi! I am in a leased home right now with a pool. Our lease details the responsibilities of the tenant and the responsibilities of the landlord. Under the lease, the landlord's responsibility includes the repair of any of the appliances, the pool (tenants are responsible for maintenance/chemicals, but not repairs), as well as the house itself. Around the beginning of May, we opened our pool and found that we had a problem as over the winter, the lining had slipped a bit. We also had recently had a lot of rain and the ceiling in our kitchen had started to sag. Since the toilets had never really been working 100%, we also mentioned that to her. The screen door also fell off a week prior. We wrote her an email detailing all the repairs that were necessary. The landlord came out the house and looked at everything, agreeing that the repairs were indeed necessary. That evening, the ceiling sag popped after she left, creating a quarter size hole in the ceiling. The landlord called a roofing company and her insurance company as there had been hail recently. Both companies came out and assessed the damage, stating that it was due to a water leak in the roof and not hail. She came out with a handyman(her boyfriend) about a week later and had him look at the toilets and did get them to work (temporarily). He also bought a new screen door and replaced it. She said that another handyman would be coming to do the roof the following week. Regarding the pool, she also would call the pool guy that she uses.
The pool guy finally came and also determined that there was a leak and drained the pool. Then he left and did not come back. Long story short, we argued back and forth (via email ) about the pool man's lack of communication. Finally after 3 weeks with an empty pool, I called him over and over until he answered. He agreed to come out and rig the pool so it would hopefully not leak anymore as the landlord would not do the repairs necessary to fix the leak. He did so and the pool still leaked. There was another 2 week silence and then he came and shut off the jet that was leaking (which the landlord did the last time this happened about 3 yrs ago according to the pool man) Now there is only one jet and it DOES NOT circulate the water sufficiently to clean the pool. I have had to start cleaning fully daily if I want it to stay clean, which has never been necessary in the past.
Back to the house....so the toilets worked for a few days after which they promptly stopped working again, requiring us to flush a few times to clear the toilet (in my opinion a health concern). We immediately told her and she said that the repair guy could address that also when he came out. Also, the pipes hum a high pitched noise when we use the water (developed in the last week or so). Since then, the garage door has broken. Our landlord is out of the country until this week sometime. When she left a month ago, she gave me the name and number of the "handyman" who I promptly called. He told me that he was working out of the state and would call me the following Monday when he got back. I have called once since, but couldnt get him.
Thus, the repairs still need to be done, and keep accumulating. At this point I just want out but am curious as to what legal right I have to break the lease as I have found a lot of conflicting information. I am nervous about paying another month's rent as well as continuing what I consider a broken agreement (the lease) when these repairs have not been addressed. I also want to mention that I have emailed the landlord about these repairs over and over and have all these emails back and forth.
