I was wondering if I have a case for countersuit against my former company. Let me start from the beginning, I work in the Title research field for Real Estate property in New York. In 2007, myself and 3 other employees quit the company we worked for to form a startup title company in Staten Island. On the day of our self termination, my office manager and one of my Bosses grilled me about where I was going and that they would sue us for leaving. I was outright told by both individuals that they knew it wouldn't go anywhere but that they just wanted to hurt us. Other employees were later brought into their office and were asked about us and told the same. Because this is such a competitive field, they were afraid we were stealing clients. We did not take any accounts with us from there. I was further informed that they told other examiners and staff in Staten Island in particular, To not aid us in any way in utilizing the court systems or records in Staten Island. They brought one case against us in late oct early nov which was dismissed for insufficient evidence and cause. Rather than appealing this dismissal, They opened a new case with a new index # and the only added thing was an exhibit of block and lots without companies or documentation of exactly what they claim we did with these properties, they claim we used from there system. I won't get into specifics but these are public records and our passwords were not timed out after we used the computers so anyone had access when we went to the field (courthouses) to finish titles. Also this is coming from their own programmers not a third party. My question though is does this not constitute malicious prosecution and Harassment from continued work in my field of expertise?
