Can i get joint custody

Okay so... I live in columbus ohio currently. I plan on moving to ky(where i am originally from) i am the father of a 2 yr old little girl. Since the age of 6 months i have regularly saw her and had overnite visits 3 days a wk. Since mentioning my idea to move back to ky the mother of my child has said that she will file for full custody and no longer let me see her. We have never been to court but i want to take her to ensure that i still get custody after the move. What are my chances of being able to get joint custody living 3.5 hrs away? Can i get abandonment for leaving the state before proceedings were finalized?

You appear to be an unmarried male alleging to have fathered a child.

You need to first establish paternity via genetic testing in a court of law.
If the child is living in KY, that's where you start the process.
If science proves you to be the father, you then files for VISITATION, and child support.
You won't get custody until you first get visitation.
Once visitation is approved, you wait about two or three years, then you cna file through the courts to obtain some type of custody.

All you really need to know, is you'll need to hire a lawyer.

When you get to "KANETUCK", settle in, then visit with three or four lawyers, eventually hiring one.

Army judge tbh I'm just worried to death that if I move to another state I won't be allowed to be in my little girls life. I'm a good father. I have proof of the duration and times I currently get her. Her mother threatens constantly that she can take her away at any time she wishes. I don't want to lose my relationship with my lil girl. Also I have a son due in july. All my FAM lives in ky. What can I do?

You have to go to court, request a court ordered DNA test, and if the test says you are the father, the court creates an order.

Part of that order addresses child support, and it will lay out court ordered times you get to visit with your child.

If you had done that, the female that verbally abuses and threatens you wouldn't be able to do so, because you'd be holding a court order.

This is one of the bad things about an unmarried male breeding children.

He has NO rights, until he goes to court t get his paternal rights.

You need to talk to a lawyer in Ohio before you move.

Ohio has jurisdiction over the child.

KY has no say in what happens with the child.
KY will eventually collect child support and send it to OH.

Talk to 2 or 3 OH family law attorneys, and see what it take for you to get a court order to make you a legal dad.

Heck, without the DNA, these days, you just don't know even IF you are married.

OK thankyou. So I just need to get advice from a lawyer before I move? Or do I need to get approval? If I move typically how long would I have to wait to see my daughter?

And court appointed visits? Do u mean visits with the mother present or visits overbite at my own place of residence?

You can move anywhere you want to move.
Your problem is you don't have an existing custody order, or an order of paternity.
You're operating off of signing the birth certificate.

Just so you know, signing a birth certificate when you are unmarried before obtaining a DNA test does nothing for you but bring you responsibilities without rights.

Moving isn't the issue, because the baby will be staying in Ohio.
Therefore you need a child support order and an order of visitation setting forth days and times when you are allowed to visit.
Most of the time it will be supervised, and eventually you get to go eat a pizza, play in the park, etc...
Then you get an overnight, eventually a weekend.

All you have done won't count for much in this, and if you gave he rmoney, it won't help for child support.
The court will call that gifts.

You'll need to set aside 30-40 minutes to visit with a couple lawyers, then a longer follow up visit to plan what you'll need to do.

You'll need to return from KY as this progresses.

It all works out, it just takes time.

First you have to establish your paternity.

Then who knows. The fact you are creating the distance between you and your daughter I'm not sure you will get joint custody especially at that distance. She has been in the same situation for 2 years. The court isn't going to want her uprooted from that.

You would likely get visitation. No you aren't going to get abandonment because you don't have any rights to this child until you establish them.
