I recently left my wife of 5yrs. we have a 5yr old child together. can i get into trouble if i keep my daughter and start the divorice proces?

In a case such as yours, he/she that strikes first establishes a better position.

If you take the child, before a court speaks (and file for divorce and emergency custody) your position will be stronger. Attack, attack, attack. Without a court order to the contrary, your rights are equal to hers!

You wont get into trouble but the courts will allow or could end up giving custody to the mother as long as their is no evidence of abuse here. Good luck.

What's more important here is who has been the child's primary caregiver.

If Mom has been a SAHM for example, she'll likely remain the primary custodial parent.
