Still married but both want separation. The landlord is willing to allow the kids and I to stay but will not allow it if she's involved as she's been lying to both of us (telling him we couldn't pay, telling me she did pay). Once we got together and chatted we both realized what was going on.
She's already been staying with someone else (never spends the night at home, just comes home to see the kids sometimes). Upon finding out that we'd be evicted, she said she had made arrangements to move in with someone else along with the kids.
If he'll let the kids and I stay, I'm afraid she'll refuse to leave. I'll be filing for separation but it's a bit of a catch 22. Can he evict only her? What can I do?
