Can I make my husband Leave if the house is in my name only?

Back in June, I found out there was infidelity on my husband's behalf and I've tried to make it work for the last 7 months. I told him a month ago I want a divorce and I want him to leave the house. Don't get me wrong, there has been a lot more that's gone on other than the infedelity. We have 3 children under the age of 5 and he refuses to leave. He says that he is not going to sign the divorce papers and that I cannot make him leave, so we're 2 unhappy people, I feel, forced to live together.

There is nothing but arguing in the house which is horrible for the kids to witness. I am tired of him being in the home and I would like to know what my legal rights are as far as getting him out of the house. Please let me know what I can do. I want to be as fair and civil as possible, I know I could get a restraining order but that would be my last attempt.

If you havent filed for divorce and asked for sole possestion of the house, you cannot force him to leave. You really need to see an attorney.
