Can I persue legal action for this?

Recently, my relationship with my ex-girlfriend has been terminated. We were living together in Vermont, but after the issue that arose I could no longer stay in Vermont. I moved back to Florida with my family so I wouldn't be homeless.

While living with my Ex, I had all my things there, now that we are no longer together and i am no longer in Vermont due to obvious reasons, I'm having trouble getting my things from her. I've sent her money that we agreed would be used to send my things, It's been almost a month and we've had little to no contact since this. I have proof of cashing the check, receiving my check and depositing the money to be used for my items.

If she does not, or refuses to send my items, is there anything I could do?

It is almost IMPOSSIBLE to sue in small claims court across state lines.

Jurisdiction is the major issue in small claims cases across state lines, when bringing suits before courts that are NOT of record (or lower courts).

Small claims courts are usually courts of lower jurisdiction and often are NOT courts of record.

For example, small claims suits are tried before Justice of the Peace Courts in Texas.

Texas JP Courts (and Municipal Courts) in Texas are lower courts and are NOT courts of record.

Therefore, a JP Court suit would be hard (if NOT impossible) to serve a defendant in Idaho, for example.

D'oh! Never send an ex money unless you are under some kind of court order to do so.

That doesn't mean much. She will say it was a gift. You won't ever be able to prove what you two had agreed what the money was for unless she admits to it.

Yes, go get your stuff, or send someone to do it for you. She is under no obligation whatsoever to send you anything. You left your property behind and it is your responsibility to go back and get it, not hers.

I have an agreement with the Hinesburg police department that my things will be sent to me, I seen a few of my things on Craigslist so, I guess now It's time to get ahold of them.

I'll bet YOU weren't the ONLY one to see your stuff on CraigsList!!!! :dunno:

More than likely, lots of what USED TO BE your stuff now belongs to some other sucker who got DUPED into paying your "ex" for YOUR "ex"stuff!!!! :o

I feel sorry for you dude, I really do! :yes:

That she-devil seems to have done you more wrongs! :cussing:
