Sorry if this is lengthy, but I rather put too many facts than not enough. First, I am living my own personal War Of the Roses, yes, an ugly (recent) divorce. To give you an idea how evil this man is, I was divorced in 1 year 10 days after 30 years of marriage. He is trying everything he can to destroy me. Okay, on to my story.

My property settlement agreement and divorce settlement specifically states that any of my family inherited property was to go to me. I was given 90 days after the signing of the divorce to remove my items from the home (I left for safety reasons). He bought out my interest in the house (before the market crashed :D ) and I signed the quit claim deed in August. He blocked every attempt, stood me up and put my possessions in the garage, where they were in the worse possible condition. I have 30 pages of damages. I had a $400 drycleaning bill. I had to pay movers and private security a hefty minimum for the trips I was stood up. This totaled in the hundreds, most likely well over 2K if you include my attorney's time billed to me. After I took inventory, still much was missing. I took inventory and sent it to my attorney. He was reluctant to go to court for damages, restitution and noncompliance with the signed agreement - he afraid that I would lose and be stuck w/ both legal bills. I yielded to his advice.

SENTIMENTAL BAGGAGE: These items are all I have of my parents and the value to me is priceless. The total dollar value is probably around $6,000. My youngest son was using my computer last night to look up something my ex's new bride put on eBay for him. I am sure my son had no idea he was giving me the keys to their racket. When he was asleep, I logged onto ebay and copied 14 pages of screen shots where my personal items were up for sale. I could only copy the listing of 275 items that were archived - no doubt my connection to my family has been sold for pennies. Of course, I fired off some (not all) of my screen shots and a sample of the listings. There is no doubt that these items are mine. First, I described the items in detail in the settlement agreement that the judge signed. And two, my brother, friends and family can verify these items are mine as most are unique, one of a kind collectibles.

Now, at the end of the business day, I find my attorney is out of town and his new legal aid appears, well, unfamiliar. This is not some hick attorney. I am paying this man $300 an hour for his services and at most have a $200 tab currently (but ex was found in contempt in the discovery phase and ordered to pay my attorney $500 - what I am getting at, he is not ignoring me for nonpayment. I have paid this man close to $20,000 so far).

I am starting to feel like this is a nuisance item to my attorney.....and I don't know if he understands how losing my pieces of identity has me terribly upset. I know he carries a palm and a laptop, so I am certain he has my email. And silly me told him I would be happy to have a Reader's Digest response - yes, you have something we can move on, or no, sorry.

I have so many questions, and even worse, I don't know what questions to ask. Are my ex and his bride selling stolen property? Is he in contempt? Can I demand restitution and recall of my property? What police do I call? What does eBay need to open their records to law enforcement? Do the buyers of these good have to return my items? How do I determine if my attorney is dragging his feet and I need to find someone else (maybe w/ cyber law experience, to work w/ my attorney?)

What kind of lesson am I teaching my kids if I do nothing?

Any thoughts, questions I need to ask, or opinions on this situation would be sincerely appreciated.
 
Sue him in small claims court for the actual and direct dollar amount of your damages.
