Shoplifting, Larceny, Robbery, Theft can i press charges

i was power of attorney for a relative who was not in his right mind. i am also pretty much the sole heir of the estate. my niece stole money from him and i did not press charges i informed the local police that i did not want her to get in trouble just pay back the money. it has been a year he is dead and she hasn't paid the money back. i threatened her. She replied by saying that i had no right.
she said i was wrong for using some of his money personally before he died. I did use some of the money. can i press charges against her. can i get in trouble for using the money?

You probaly cannot press charges since you already agreed to allow her to pay the money back. She either stole, or she didn't. If it was a legit theft then you should have pressed charges back then. The DA probably would not prosecute a weak case like this but you can try.
