Can I require payment in full?

Tenants signed lease & gave partial payment of security deposit. They will move in Oct. 1, 2009. Can I require that they pay the entire amount now rather than waiting until October 1, 2009 when the rent is due?

Why did you acept partial payment of security in first place? What was the agreement then?

The partial payment was non refundable for us to "hold" the rental to protect ourselves if they backed out.. The total to be paid by the Oct. 1, 2009 date. We'd asked for the security deposit of $700, but there was a cash flow problem.

You mention partial payments now your saying the monies were to hold which is it?

They gave money to "hold" the rental, if they didn't follow through the money would not be refunded. If they didn't back out it would go toward what was owed in rent or security deposit. Had had a bad situation with someone backing out after putting down a security deposit. A long story, but we let them out of the lease.
