Can I sue a dealership for breach of contract or defamation of charac?

I traded in my vehicle. They failed to pay my trade off in time to their OWN financing. I've lost over 100 points in my credit score due to this derogatory remark. I also have the fax the dealership sent in admitting and accepting full responsibility for the late payment... Can I sue for monetary damages?
 
What harm have you suffered other than the credit score? Has it caused you the loss of a job, a home, financial difficulties? Have you approached the credit bureaus about this?
 
I don't see a case for monetary damages based on what you posted but you can contact the credit reporting agencies re correcting the information.
 
The credit score is easy to repair and there is a process in place for doing so. The dealership letter acknowledging the error should make it quite easy. Mistakes happen. There is no payday in this for you.
 
I've worked in dealerships for over 35 years in more than one state. I've never heard of any law that's says we have to pay off your trade within any given time-frame. It's generally in our best interest to pay it off immediately for several reasons, but there are several things that can happen to cause the payment to be late. At this point if the payoff did get paid and the dealership paid any additional interest and/or late fees, then the only potential harm to you is the bureau score which can be corrected.
