Can I sue an E-Bay seller?

I live in Canada and about 6 months ago I bought a vase from an Ebay seller who lives in Philadelphia, PA. When I made the purchase, I paid for the vase and shipping ($313US) and asked the seller to hold on to the vase for me and that I would provide him with a shipping address later. I told him it would take at least a month. He said it was not a problem and to let him know when I was ready to ship. A couple of months later I contacted him and asked him to ship the vase. He told me that he waited and waited for me to contact him and then sold it to someone else locally and refuses to give me back my money. How do I sue him if I live in Canada?

You should probably take it up with eBay first. After that I would consider a lawsuit.

Unfortnately, it's out of Ebay time limit. What I need o know is how to sue a person who lives in another country.
