I got into a altercation with a co-worker who never liked me. It started in the laundry room over sheets I quickly got away from the incident and informed my boss. Who told me to see the head nurse. The other party in this incident beat me to the nurses station. There she was told to leave it alone until the could handle it. As I stood talking with another co-worker the aggressive lady who never liked me attacked me from behind! It was quickly broken up by others. The police were called and the other party was labeled the Aggressor due to witness reports and security cameras. Yet my boss fired me because it happened in the lobby amongst residents and I didn't try to diffuse it(but I reported to him as soon as I could after the 1st attack and the 2nd came 10mins later) But I didn't ask to get attacked and I have nothing to fall back on. I've been crying since I got fired head hurting body hurting from being attacked I was already living pay check to pay check and now I don't have a check at all. I want to know if I can sue the employee who attacked me for loss of income and emotional distress?

You can sue the attacker. You can sue anyone. To prevail you must show damages. Usually assault victims prevail for their injuries.

Forget the emotional stuff. If you are under medical care, those are the expenses you can recoup.

You can apply for unemployment insurance for some income. The state will decide if you qualify.
