:mad:I purchased jewlery online from a very reputable company. When i received the jewelery it was, the wrong item (sent a very similar item but not the model i ordered), the wrong size, AND they had mislead me by saying it was a set when it was definitly not. I took it to a local jewler who confirmed that it was not the specifications that i ordered and was not the size that i ordered which i have in writing. I contacted the company and they want me to pay an outrageous fee for me to "return" it for them to fix their own mistakes. I feel very taken advantage of and want to know if it is even possible for me to take them to small claims court or what type of legal case i may have against them.

Sure, you can sue if you live in a different state; however, the lawsuit must be filed in the county where the defendant (i.e., the business) resides and not through your own county court.

Often filing can be done online, although you'd need to travel to the defendents county for the actual hearing.

Make sure that the amount you are asking for in the lawsuit does not exceed the amount allowed in Small Claims for that particular state.
