The beginnig of August my then boyfriend put a down payment on a car for me. I didnt even know he was doing it until I started to sign the paperwork. He put the $7,000 down payment on his credit card. The car and lease payments are in my name only. He told me I did not owe him a thing...that he was doing this to make me happy. Now that we have broken up he says he will sue me for the money and has even gone as far to steal every key to the car. He doesnt even care about the money he just wants revenge. I know anyone can sue anyone else... but can this guy actually win? Is it my word against his? Or is the person with the best attorney and loads of money going to win?

First of all if the car is in your name only, it is theft if he steals the keys or the car and if he does that, call the police. It is your car, not his .

Secondly, he needs proof that this was in fact a loan and not a gift.

If you get a summons you need to respond to it and or show up in court.

If he takes this outside of small claims and you have to hire an attorney, you can ask that he re-imburse you for legal fees.

The burden is on him to prove it was a loan and not a gift.
