i need help finding out what are rights are and legal advice on a case dealing with dss. my fiance and me are trying to get custody of his grandson. the grandson was in the custody of his grandmother up until about a year ago, when she had got into some trouble, and dss took him away and placed him in temporary custody with his other grandfather,(his mothers father). His mother then got custody back of him and has had him for around 4 to 5 months. They moved to another county, and two weeks ago Laurens county dss came and took him away from her, and placed him with the guy she was living with at the time, his mother, who is not at all anykind of relation to our grandson. They held a hearing this past Tuesday, they held a hearing in Laurens county, where we are trying to get him back home. they denied letting him come home to anderson county, where all his family is. Me and his grandfather want to get custody of him, because his mother will never be allowed to get him back. his mother has failed several drug tests, and his grandmother who passed away three weeks ago, had been busted for drugs, that his why she lost custody of him. Dss is telling us that we will have to take drug tests, and go through a home inspection. I know that there are certain procedures that you must to satisfy dss, but my thing is not that i wont take a drug test, but we have never been in any trouble with the law and have never had any thing to do with drugs or drug related. I quess what i want to know is this a mandatory procedure with dss, and what rights do we have in getting our grandson back with us, and what legal steps do we need to take to get him home. can someone please help me out? This child has been put through so much in his life already and I just want him to be able to have a stable home and a normal childhood. So please help me.
