Can they do this?

I work about 3 days a week at a local bar in addition to my full time job so I can pay off my student loans. My employer has not paid us the correct minimum wage since 2007 and refuses to pay overtime. I am currently making 3.43 an hour and supposed to be making 3.65 while its only a difference of 22 cents an hour, I feel this is my money and I am entitled to it.

I have brought this up to one of the managers before and was told that this wasn't his problem

Last Friday, I was talking (complaining) to 3 of the girls that also work there about how I feel about not getting paid the correct wage. I asked them what would happen if I brought it up with the owner and all 3 of them agreed that I would be fired b/c of it. I completely agree that the bar would (or would try) to fire me. So I told them I would probably just call the dept. of labor and let them deal with it.

When the next weeks schedule came out two days later, I was not scheduled at all! I called my manager and asked her if there was a reason why I was taken off the schedule. She said yes it was intenetional and out of respect to her family she would not discuss it!?!?! I have repeatedly asked why I was not scheduled and not only can I not get an answer, but they wont even respond to me.

I don't believe I have done anything to warrant not being scheduled. In the past year and a half I have worked there not one person has ever been punished (for anything) by being taken off the schedule.

Can they do this?? And what should I do next?
 
first of all you should file a complaint with the labor board about the incorrect wage.

second, if they have taken you off the schedule in retaliation of complaining aobut not being paid the correct mimimum wage that might be illegal. I would call the state labor board first and go from there.
