I own a company that is owned $3000 by a painting contractor. It is a commission we have a contract on, for referring work to them. 3 seperate jobs were referred, and they haven't paid, and have ignored collection notices.

I'm considering going to small claims court, but found out by hiring a P.I. that the owner of the company already has a $15k judgement against him (unpaid) and is now in court for another judgement. I know the company is still painting houses and making money. When I go to small claims court, do I list the owner or the LLC? THe LLC is making money, the owner appears to be broke. Thanks.

Who was your agreement with, the LLC or owner? Do you have a contract with the LLC or with the owner? You can only sue the person with whom you have the contract.
