My mother's nursing home sought & received a default judgment for a past due balance against both her and myself as her P.O.A. & joint signer for responsbility for debt. Her house was foreclosed on by nursing home but bank cross-claimed and house sold short. Lawyer was granted a garnishment order on my wages for the full default judgment at 8% interest per annum (even though that amount included payments not posted yet). My wages have been garnished since Dec. 2009. My mother no longer resides at this nursing home. The debt was paid (by funds from long term care insurance, mothers' social security & the garnishments). Nursing home's statements now show a credit balance. I cannot get the nursing home attorney to respond to my certified letters and my wages continue to be garnished. Garnishment checks are mailed to the law firm but not forwarded to the nursing home. Do I have any remedy? Will I have to pay the full default judgment including 8% per interest per year? That amount is $21 K plus interest.

Contact an attorney. This too complicated for us to properly address on this forum. You have a remedy. But, you'll need an attorney to file a couple motions for you. Please, for your own sake, talk to a couple local lawyers.
