hi, last year a purchased a vehicle and a friend of mine cosigned for me. well me and him are no longer friends. i got behind on payments due not being paid..instead of having the car repossessed he offered to take the car and refinance it in his name. this was 2 months ago, and no action has been taken on this issue. now i cannot get another loan for a car because my name is still on this car loan, i do not make the payments and i do not have possession of the vehicle. Now the problem is that he is taking his sweet time refinancing the car because he can. is there anyway i can have my name taken off the loan, or get the car back? if i get the car back i can trade it in.

You can ask the lender if they will remove you from the note.
Tell them you no longer have the car because the co-signer took it from you.
It might work.
Legally do they have to acquiesce? No. But, if you ask real nice, maybe. Try to speak with a person higher on the food chain than a customer service representative. It might not be a bad idea to write a letter to a vice-president of the lender.
