Car Crash & Conflicts of Intrest

On a two-lane rural section of US 8 in Minnesota, a motorcycle driver with a passenger made illegal u-turn causing me to swerve and lose control of my car. While there was no collision, my 9-year-old car was totaled and I sustained serious injuries. The motorcycle driver fled the scene but, thanks to witnesses, was later apprehended.

The good news is that I will recover. The bad news is that the motorcycle driver has the same insurance company as mine. The insurance company's repeated requests for my description of the accident is giving me the feeling that my interests are not high on their priority list.

What prevents the insurance company from taking advantage of this situation? Are punitive damages feasible to cover the cost of a lawyer?
 
I suggest that you retain an attorney to represent you. Why should your version be any different that what you have posted?
