I am in Texas, purchased a used car from a Toyota dealership in Nebraska. We negotiated for a bit, and settled on an "all-in" price and the salesperson took the $1000 deposit right away. The car dealership sent over signed purchase agreement, financing, etc. with the VIN for me to sign. The documents, however, did not include tax, title, license, tire fees, delivery, etc. They included a singular "dealer fee," and everything else I had to take care of myself. I deliberated for a week because of the extra cost, but ended up signing and returning the documents. Due to the deliberation, now the salesperson is telling me that they had sold the car to someone else who "had less issues."

What recourse do I have? Can I still claim the vehicle even though they said they've sold it to someone else? Does specific performance apply here? If so, how can it be pursued?

I suggest you get your $1,000 back and move on.

If you sue, you'll have to make SEVERAL trips to Nebraska, and you'll probably not prevail.

But, you're free to sue in Nebraska. Get your traveling shoes on.
