I moved to california from texas without notifying the lien holder of my car... which is apparently a 3rd degree felony (i was caught up on payments when i left for what thats worth.). A couple weeks after i got here the car blew a head gasket and I spent what little money I had trying to fix it.... which didnt work. Im now 11 days late on my payment and the car place is telling me I need to send the car back to them or pay the late payment now or I risk jail time for moving mortgaged property out of state without permission. Is there anything I can do? Do I have any legal options? Will I really get thrown in jail? I had only had the car about 6 weeks before it broke down on me (and it had problems from the start) so its bad enough I dont even have a car anymore and likely have to do a voluntary repossession since I cant get it fixed...... I really dont want jail time to be thrown into the whole thing.

I dont think they can throw you in jail, This is your property- however in your loan documents i am sure it states you are in violation of your loan contract if you fail to inform them where you take the car-- so they are upset because you have moved and your payment is late-- if this is a high risk (dealer) lending co -- I would make some sort of arrangement w. them ASAP or tell them to come get it. otherwise they will pick it up anyway. they may or may not pursue you for the deficent balance once the car is sold

i told them to come get it. they said they cant cause its out of state. then they told me i have to transport it back to them or face the felony. are they just trying to avoid incurring the cost of repoing it from out of state?

another problem is the longer it sits on the street the more tickets i will get from the city (already got 1).... how do i keep from building tickets till they repo it? bear in mind its non operational so i cant move it more than a few feet

It is a lot more $$ for them to repo it out of state-- Read the fine print on your contract-- let them know that the city wants to impound it and once that happens they will have to get it from the state (much more of a pain )-- how far away are they? tell them you want the law code on them being able to throw you in jail-- if they cant provide it, tell them to pick it up before the state does, and maybe you wont file a FDCPA claim for threating jail time
