OK, I must explain the back story so people understand the situation. I need to know if I have a case or not.
Back in April, My boyfriends brother & stepfather offered for him & myself to assume payments of a vehical. There was only $2300 left on the loan, with monthly payments of $250 ($125 bi-weekly). We went down to the lot, and my boyfriend became primary, and his step father cosigned (due to credit). We all 3 made a verbal agreement that my boyfriend and I would make payments monthly to the dealer and once paid in full his step father would sign the title over to us. My boyfriend knew I needed a vehicle, so this was a great deal. My boyfriend and I then discussed by ourselves that he'd make payments until I found employment. Needless to say, he made a few payments and then I found employment. I made a total of $500 in payments for june & july. In august, I lost my job due to having to move 50 miles away. My boyfriend told me he'd assume payments again until I recieved my pell grant in september, and I could pay him for august when I got it in sept. Well, I recieved my grant and paid him 300 instead. He paid for sept & the first bi weekly payment of oct, due to me having trouble finding employment again. Now, Novemeber comes. He is broke do to being laid off, and he can barely keep his own car. The dealer is calling him & his step father over & over again threatening reposession if not paid SOON. There is only 1 payment left on the vehicle for $250. Boyfriend calls me tonight and tells me all this. He tells me now that his brother & step father want the car back, and are willing to pay the last $250, and in turn give my boyfriend $800 for what HE has put into it. When just months ago when it had $2300 on it they wanted to just get it off their shoulders. I tell him I can have the $250 tomorrow, I can get my uncle to loan it to me. He says it's not his choice. 2 hours later his mother & brother are here asking me for the keys. They take the car. My boyfriend doesn't understand that I deserve a portion of that $800 he's recieving for the vehicle, considering I paid on it too. I am being left with $0 and no vehicle, and i'm VERY upset.
What I want to know is - Can I legally take this to court? If so, who do I file against? The step father considering he's cosigner, my boyfriend considering he's primary (FOR RIGHT NOW) or against his brother considering he'll be the new owner within days?
