Car wreck

I was involved in a car wreck last year. It was the fault of the other party and he was supposed to pay for my car. I found out later that he didn't have any insurance when his insurance company called me. I just had the liability coverage so my insurance wont cover either. I am planning on taking this matter with the small claims court. I am not sure if I can still do it. Its been 13 months now. Please advise me if I can still do it.

Take him to court.

Be prepared to be just a tad more clear than this: "I found out later that he didn't have any insurance when his insurance company called me."

Actually the cops didn't care for his insurance card and they didn't give him a ticket either. I asked him if he had insurance he said yes but later I found out that his insurance had been cancelled for non payment.
Anyways you think since its been 13 months I am still okay with taking him to court. What should I say to the court that why it took me long ?
To be honest the reason I didn't sue him earlier is because i didn't want to get into legal matters or waste more money on an attorney but now I decided to go for it.
